Hi, it is 7:11 AM Tuesday morning and this is Bob Barney with the Plain Truth today Broadcast.

Yesterday we started talking about what is wrong with the Bill of Rights. 

I wanted that topic after a few weeks ago having done What is Wrong with the Ten Commandments? We did this because the Ten Amendments of our government are just as important to your civil life and your criminal life, maybe, as the Ten Commandments are to your spiritual life.  The Founding Fathers required these Ten Amendments to be attached to the Constitution called The Bill of Rights or else they wouldn’t sign the Constitution.

Al lot of people think that The Bill of Rights protects the majority, and it can, but it mainly is a document that protects the minority against mob rule of the majority. I have always said we are not a democracy, that is mob rule. A democracy is when there are 5 people and 3 of them vote to kill the two…but that is not what America is. We are a democratic Republic where majority rights are enforced but there are minority rights that protect the minority from a mob rule democracy. 

A lot of this comes from The Bill of Rights.

I went through the first 7 yesterday, very important…

The last three I will do today and spend most of the time on the 8th Amendment because of what is going on in the news. It is very important because of what is going on in the news.

I do not believe that most of the news stations or newspapers and sites that you watch and read, or even the radio station you are listening to are presenting to you The Plain Truth about the 8thAmendment and how it is being seriously compromised.  What they are doing to Donald Trump in his civil suit is something I will be explaining.

The 8th Amendment says that excessive bail shall not be required.  That means that bail must be equal to or less than the crime.  If the crime is murder, for years there was no bail for murder of the first degree. Sometimes it is waived for the defendant but mostly not. Especially in times of theft if you steal a loaf of bread back in the history of the modern world when the Forefathers wrote the Constitution, people were put away for 20 years when they stole the bread. 

Also, you might steal a loaf of bread because you are poor and hungry or let’s say a day’s wage using today’s figures, is 250 dollars…you head to the grocery store and steal a bottle of wine that costs 15 dollars…the judge says your bail is 10 thousand dollars or else you go to jail. That is excessive. Your bail should not be much above if any bit above the 15 dollars or there should be no bail at all. That is just the easy and simplest way to show what the first part of the 8th Amendment is about.

Bails limit should equal the crime. It is that simple.

You should not be put in jail because you cannot come up with the bail money because the bail money was set artificially higher knowing that you cannot afford such a fine on a petty crime  It is probably done today across the country where we are not aware of it, a lot of people most likely are in jail because they are poor and could not get a good attorney.  Even the public defenders were most likely not good, a lot of important things overlooked and lies told by the police and investigators and what not…people because of their poverty are in jail who do not belong there.

The second part of the 8th Amendment: This is the heart of what I want to talk about today. Nor excessive fines be imposed.

Well, we have a case where Donald J Trump allegedly assaulted, not raped, there is no hint that he even touched the person in my opinion if I read the case right…but the person claimed that he assaulted her and she cannot remember the year or the date, but she was harmed.  He was fined 454 MILLION DOLLARS for a non-criminal assault they couldn’t even prove, and the alleged victim suffered damage. She couldn’t prove 454 million in lost wages on her part at all…or prove even her case was true. The 454 million dollars set by the judge was merely to try and confiscate his property by stealing it…by breaking the 8th Amendment.

There has never been a case in American history that has allowed a case to have such a large fine on a crime, even if there is a crime at all here, don’t forget.

Why would you post a 454 million dollar fine? Because when you appeal after losing in a lower court, many times, especially in small Rinky dink neighborhood and town type cases, they are kangaroo courts. The judge and the prosecutor are best friends, golf together and a part of the same country club…you see this a lot with hospital bills. The hospital will charge 5000 bills and the insurance company will have to take 385 dollars offered from the insurance company…then the doctor writes off the remainder. You see this all the time. But if you were a poor person and had no insurance, the hospital bills you for 5 grand and this is excessive. They should not really be able to charge you that kind of money unless they are wanting to write it off to another insurance company.

They will take you to court for the money, you are poor which is why you didn’t pay the money in the first place…you couldn’t afford a lawyer, the judge and the hospital attorney and staff, the pillars of the community are all in cahoots with one another. So, what do they do? They give you a fine that they hope you cannot afford. So, when you appeal this decision and will probably win on appeal, you have to post the amount of money still found against you, first. 

If you owe 5000 dollars and you couldn’t pay it, they have the right to impose a 5000-dollar fine/judgement against you. In order to appeal this, you have to come up with the 5000 dollars putting it into bond and the court holds that money and the court of appeals will decide your case. If they decide for you. then you get your money back. If they decide against you the money goes to the plaintiff unless of course you appeal again to a higher court and you can appeal it theoretically all the way to the SCOTUS. 

The 8th Amendment says that if you have These 5000 bills, they cannot fine you 4500 dollars and not even be able to appeal the case. That is a crime in itself in the judge’s chamber. There are many corrupt judges and prosecutors, policemen, medical examiners. We see a judge right now who is so blatantly corrupt in NYC right now to fine Trump 454 million hoping he would not come up with the money and give the rights to take possession of all of his property. Without just compensation…one, and two, that he couldn’t appeal the decision because he couldn’t come up with the money to do so. Total bunk crap.

This should have been appealed to the SCOTUS immediately because of who he is and the fact that he is running for president. On terms of the 8th Amendment. There were excessive fines for petty crime and the entire case should have been instantly thrown out on the 8th amendment alone. I am not a lawyer, but I can read with my own eyes what it says. If you can show me in history that a 454-million-dollar fine was ever put on someone, I want to see it. You won’t find one. There is not one.

This was the most quickly reversible court case I have ever seen in my life. I am quite disgusted by the way that it wasn’t instantly brought to the federal court and then the SCOTUS. Clearly excessive fines and the judge should be removed from the bench.

The third part of this amendment. Nor cruel and unusual punishment inflicted.

Again, we mention the thing that used to happen during the time when the Constitution was written. Someone would steal a loaf of bread, be convicted and the imprisonment could be 5 or 10 or 20 years for a loaf of bread. A loaf of bread worth less than a tenth of a day’s wage and someone loses five years of their life in prison.

I promised you a side story on Charles Manson. When Sharon Tate was murdered by Mansons associates in 69, he was not present, he was found guilty of first-degree murder because he planned and ordered this execution of these innocent people, tortured them, a horrible crime. He was found to be guilty of murder in the first degree and sentenced to death. In the early 70s, not sure the exact date though, the SCOTUS outlawed the death penalty in all states based on the 8th Amendment. They were wrong, but they said it was cruel and unusual punishment.

There are many people today who believe that the death penalty should not be inflicted because of the fact that the government have lied so much, policeman lie, and prosecutors lie…but the idea with Manson, once the SCOTUS ruled that the death penalty had to be taken away from every state, Charles Manon was spared execution.

Through legal maneuvering and through state and federal government laws, the death penalty was made legal again, not sure how but they overcame the SCOTUS decision, and the death penalty has been allowed by state…like abortion today. Like the SCOTUS did with abortion. left up to the state. Because of the double jeopardy, Manson therefore could not be reissued the death penalty that he was given because the court has ruled against it for him so he was given life in prison and could not go back on death row. Just a little side note about how the 8th Amendment has shown up in our life time. Many people do not know the procedures that were followed in this instance.

Ninth Amendment

The enumeration in the Constitution of certain rights shall not be construed to deny or disparage others retained by the people.

This is a general rule. The 9th and 10th Amendment are actually sort of like the 9th and 10th Commandment in the Mosaic Law. They mean somewhat the same thing. The 9th Amendment is saying that with the passage of the Constitution, the things not spelled out within this document shall not be construed in that the new government could take away the rights of the people that were not specifically mentioned in the Constitution itself.

This was an attempt to say that people were free individuals and had certain God given inalienable rights and were not legislatively prohibited in the Constitution remain the right of the people.

That is all that really means.

It is a law, one of the top ten laws that is so vague that our legislative body either Congress or town councils, have really shot holes in the 9th Amendment taking away your rights. Zoning laws for example telling you what color you can paint your house or what driveway you can put in our how often you are allowed to mow your lawn. These laws break the 9th Amendment and yet most people favor these laws because no one wants to live next to a house that doesn’t take care of itself and effect the value of your property. So, people look the other way when a certain commandment of God or an Amendment of the Bill of Rights makes it hard for you to follow.

Just like with the commandments of God, like the 4th Commandment, the Sabbath Commandment just sort of ignore it and hope it just will go away. Same with the 9th Amendment…state and local governments have passed tens of thousands of laws to take away your rights where today in the last 50 years you have about a 10th of the rights that you had just 50 years ago…and probably 1/100 of the rights from 100 years ago.

You have lost most of your Bill of Rights in the last five year with the Biden Administration. The right to free speech, now the FBI can break down your front door with no warrants in so many cases…so many rights have been lost and have not been fought to keep that may not be returned to you. I am afraid for this country that we are not going to see the restoration of the Bill of Rights and the rights of the individual.

Tenth Amendment

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

This is like the 9th but is applied to the states and not the people. This says whatever the Constitution did not spell out as a law then the state government was responsible for. That is why for example that the Constitution is actually quiet on many issues and not in the federal court system with the exception of the SCOTUS. Murder for example is really not a federal crime. It is a state crime. That is why states prosecute murderers and states prosecute criminals of theft.

If you steal from a grocery store you won’t be tried in a federal court, however if you steal a letter from a mailbox then you may end up in federal court for being arrested for that.

But the 10th Amendment is saying that whatever law we didn’t say the federal government has the right to do, the states remained in possession of that law. They can decide for themselves. The states could not be limited to do things by the federal government that was not explicitly spelled out by the Constitution. That is an important point. When it comes to the Civil War, when we talked about Lincoln absolutely trashing the Bill of Rights, there is nothing in the USA Constitution that prohibits a state after they have joined the union, to leave the union. There is nothing that says it has to stay in the union.

It reminds me of the union votes. I never got over this because I have been involved in my family where unions took over a place…there would be a union vote at a particular factory and the union would lose the vote and every single year that vote would come back up again for the people to vote for a union. Every year it would get rejected and the union would not occur. Maybe it would take as it did in one case I know about, 18 separate votes to unionize my father’s company that he was working for. Once it was unionized it was never voted on again to remain this way…you just vote until you get the results that politicians want and then there is no longer another vote. Same thing happens here with this 10th Amendment to the Constitution. The states have the right to regulate themselves regarding murders or criminal matters of petty or grand theft. The Constitution says the government does not have the right to get involved.

This also included the states’ rights to leave the union. If they wanted to leave the union, they have the right to. The idea that Abraham Lincoln invaded the states that left the union with an army, broke the Bill of Rights and even the Constitution. It was an illegal act of treason to be honest. You can think well of Lincoln for saving the union but at the same time he had no legal right to do what he did.

Let’s sum up the Bill of Rights. First of all, it should be known that the first ten Amendments to the Constitution that makes up the Bill of Rights was written by James Madison as a solution to limit government power and to protect individual liberties that the Constitution did not do. For example, the Founders found the ability to speak and worship freely as a natural right protected by the first Amendment, Congress is prohibited from establishing religion or abridging the freedom of speech of religion or of any political thing. The 4th Amendment safeguards citizens’ rights to be free from unreasonable searches and seizures. So, every day, especially if you find yourself in court, you need to know your rights under the Bill of Rights. They were put to us or given to us by our Founding Fathers to protect us from Big Government, Big State government, Big local government and Big Federal government and from the mob called democracy.

That is very important!

The individual has to themselves in the 9th Amendment all the rights of an individual that is not specifically taken away by the Constitution. That is what has made America great since the founding of this nation some 250 years ago. Whenever a person wanted to move west and start all over again, he or she was free to start a new and make a life for themselves and be free of regulation that prohibited them from achieving their goals and America became GREAT because of the liberties of the Bill of Rights. The things that we were able to accomplish because our Forefathers saw the need to protect the people from its own government.

I am telling you today, and this is my opinion, we need to be protected from Big Government. Today the government is the enemy of the American people.

Russia is not your enemy nor is China. Mexico isn’t either. The people flowing over the border except maybe the terrorists are not your enemy…they are illegal yes and should be prohibited from entering the country and deported, but they are not your enemy. Your enemy is your government who allows all of this stuff to happen. Who allows muggings and raping and no cash bail and to have excessive fines for candidates for presidents that are not liked.

Big government, big business, big pharma and big media have destroyed your rights and have done so in a very short period of time.

You have lost so many of your Bill of Rights and your Constitutional rights and y our freedoms you cannot even imagine today what it is like to live in a free country.

I find it ironic how we preach to the world about how evil the Russians are, how corrupt their system of voting is…yet WE have the most corrupt congress, president in history, judges, and corruption all over the land. Your local newspaper is owned by some conglomerate from another state most likely that has no care about our actual town and that paper is just a rag full of propaganda because of whoever owns the corporation that prints your papers. This is The Plain Truth. This is what is happening in America. We have lost our rights and keep losing even more.

I hope that on June 14th that the people of America pray for this country and go to God, asking Him for a reprieve from what is happening because we are going to hell in a handbasket. Faster than I could have ever imagined. I hope whoever is listening to me that you wake up and see what is happening to this country. I hope that you can see and understand that our Forefathers fought and died, took up arms, they were insurrectionists. They put an end to the tyranny of a king.

Right now, we are living under the tyranny of the federal government of the United States and many state governments. The tyranny of the president who has his own secret police called the FBI who will attack you if you attack the president, this is what we are living under. People from Nazi Germany would be aghast at what we are living in now.

We need to take action, number one, but the most powerful action we can take is going to God in prayer and in fasting as a people and ask God to come back into this country and to rule this country and to save this country from itself and corrupt leaders. Until we are ready and willing to do this, my friends, we are done for as a nation.

We will sink like the Roman Empire, like the British Empire, and sink into slavery. We will become slaves to a foreign people who will not treat us well. You saw how the women of Israel were treated by Hamas when they attacked them on October 7…you saw what happened to those women…that is what is going to happen to our women if we do not do something now to protect your liberty and rights…and your Bill of Rights.
